GUARANTEES

1. Dog is purebred, pedigree is correct, litter is registered with the American Kennel Club. The puppy’s individual registration application (or certificate) will be provided when payment is made in full, contract is signed, and rental crate is returned (if applicable).

2. Dog is healthy upon delivery/pick up, has been de-wormed, vaccinated, examined by a veterinarian, and when shipped by air, comes with a veterinarian health certificate. Any illness must be confirmed by a veterinarian within 72 hours of arrival, after which the health of the pup becomes the responsibility of the Buyer. If, as a result of the examination, the veterinarian determines that the puppy is not in good health, then the buyer shall elect to keep the puppy or return the puppy to the seller. If the buyer elects to return the puppy, the buyer shall send to the seller, by certified mail, a written Veterinarian’s certificate along with the puppy or sooner stating that the puppy was in ill health when examined. The Buyer shall have seven days from the date of the examination to return the puppy to the seller where it shall be examined by the seller’s veterinarian. Upon finding the puppy ill, the seller shall be obligated to provide a replacement puppy or full refund to the Buyer.
*** This guarantee does not cover common intestinal parasites or protozoa that puppies frequently pick up.  Kerstone puppies have had multiple broad spectrum de-wormings before leaving the property in attempt to be sure they are fully healthy.  If your pup developes ANY LOOSE STOOLS or DIARRHEA, ANYTIME DURING PUPPY-HOOD: Kerstone Shepherds very strongly recommends TREATING IMMEDIATELY with at least 10-14 full days of Albon AND Metronidazole.  Also NOTIFY ME as soon as loose-stool sypmptoms begin!  There is NO SUCH THING as a “negative” fecal exam, because not all worms or protozoa may be seen on just one exam, but may still be present in the intestines.  Frequent or long-term loose stools, if not treated aggressively and cleared up immediately may lead to permanent intestinal damage & life long diarrhea. ***

3. The pup is guaranteed against crippling genetic defects for five (5) years. This means that the puppy is guaranteed to live free of discomfort due to any proven genetic condition.

4. If “Spay/Neuter Agreement” is checked on the first page of this contract, the pup is guaranteed against crippling hip and elbow dysplasia (OFA Moderate or Severe on Hips, or OFA DJD Grade 2 and worse on elbows). If “Show/Breeding Potential” is checked on the first page of this contract, the pup is guaranteed to pass OFA Hip and Heart certifications and get at least OFA DJD Grade 1 or Normal on elbows. All hip and elbow x-rays must be taken and submitted when the dog is between 24 and 30 months old, and BEFORE BREEDING to qualify for these guarantees.  *If a dog fails OFA Cardiac, Seller reserves the right to request a second opinion from a board-certified cardiologist.*

5. If “Show/Breeding Potential” is checked on the first page of this contract, the dog is guaranteed to be free of any disqualifying fault listed in the United Kennel Club German Shepherd Dog breed standard, after the age of 8 months old, with the exception of nose pigment color in whites, blues, and livers.

This puppy is sold solely as a pet and companion to the immediate family (those living in the home when the puppy is first bought). Its suitability for any additional use or purpose will depend solely on the environment and training provided by the Buyer. These guarantees apply to the original purchaser (listed on the registration papers) and are not transferable. These guarantees become null and void if the buyer does not return signed contract, or does not fulfill all of the agreements on page 2, below. The seller reserves the right to a second veterinarian’s opinion. All relevant veterinary records must be supplied to the seller upon request. When cause of death is unknown, an autopsy must be performed. Buyer assumes responsibility for all costs, although the seller may offer financial help.

If the Buyer can verifiably demonstrate the dog’s failure to fulfill these guarantees, and the dog is euthanized on a veterinarian’s recommendation and with the permission of the seller, or the dog is returned to the seller with a signed AKC registration transfer, the seller will replace the dog with a puppy of similar value or give a refund, seller’s option. If the Buyer chooses to keep the dog, it must be spayed/neutered. Half of the purchase price may be refunded or the Buyer may purchase a replacement pup for half price. The Buyer’s remedy for the breach of any aforementioned guarantee is limited to the purchase price of the dog listed on the first page of this contract.

BUYER’S AGREEMENTS

1. The Buyer agrees to notify Kerstone Shepherds, IMMEDIATELY if they have a concern about health, hips, loose stools, or temperament, and BEFORE going to their vet about it, otherwise all guarantees in this contract are null and void. Email to kerstone_shepherds@yahoo.com is preferred, for fastest contact and to keep records in writing.

2. The Buyer agrees that the puppy will reside at the home of the registered owner or co-owner.

3. The Buyer agrees that he/she is not acting as or in part of, an agent in the purchase of this puppy and that the Buyer will not sell this puppy or any of it’s progeny to any agent, pet store, or business.

4. The Buyer agrees to use the kennel name “Kerstone” or “Kerstone’s” as the dog’s first name on any and every registration certificate. The kennel name will be followed by any name or letter that the Buyer chooses.

5. The Buyer agrees to register the puppy with AKC (or transfer ownership if the dog is already registered) within 1 month of receiving the form and to send a photocopy of the certificate to the seller.

6. The Buyer agrees to inform seller any time they move or change phone numbers during ownership of the dog.

7. If the Buyer is not able or chooses not to keep the puppy at any time during the life of the dog, Buyer agrees to return the dog with signed AKC registration transfer to the seller without receiving any refund. Seller will handle shipping arrangements and expenses, if any.

8. The Buyer agrees not to sell, trade, lease out, euthanize (except under emergency conditions to end suffering), or give away the dog without written permission from the seller.

9. The Buyer agrees to comply with all local ordinances regarding the keeping of dogs, in addition to providing adequate food, water, housing, immunizations and health care, and humane treatment for the dog.

10. If “Spay/Neuter Agreement” is marked on the first page of this contract, the Buyer agrees to prevent the dog from breeding (even by accident) and have the dog spayed or neutered BETWEEN 8 and 12 months of age, and Buyer agrees to send the Seller a signed veterinarian (DVM) certificate must be provided stating that the dog has been altered.  Kerstone Shepherds does NOT endorse the *early* spaying and neutering of young puppies.

11. If "Show/Breeding Potential" is marked on the first page of this contract, the Buyer has the option to someday breed the dog, under the agreed conditions that:

a) the dog will only be bred to other AKC or UKC registered purebred German Shepherds.
b) the dog has a passing hip grade from OFA or OVC, or an acceptable score, free of dysplasia from PennHIP or BVA.
c) the dog has a passing elbow grade from OFA, OVC, or BVA (in some cases a lowest level grade of DJD may be accepted as well).
d) the dog has been vet or cardiologist checked at 12-months-old or older & verified free of any heart murmur or heart defect.
e) the dog is at least 18-months-old if a male, or at least 24-months-old if a female.

After these requirements are met, the "limited AKC registration" will be lifted to "full AKC registration" for breeding rights.

If the seller can document the buyer’s failure to keep these agreements and so informs buyer by certified letter, the buyer shall have 72 hours to return the dog and the signed AKC registration transfer to the seller at his own expense. If the Buyer fails to do so, the seller shall have the legal right to repossess the dog and get a signed AKC registration transfer application from the buyer without refunding any money. In addition, the buyer shall be liable for any expenses incurred in the process of repossession (including attorney’s fees and court costs), and veterinary expenses to restore the dog to good health, if necessary. If it is not possible for the buyer to return the dog and AKC registration transfer, the seller will recover the greater sum of $500 or the purchase price of the dog, as damages for breach of this contract. The parties to this contract agree to submit to the jurisdiction of Abilene (Dickinson County), KS for any dispute arising out of this contract.

No other warranties or guarantees, expressed or implied, are made with this sale.
